Terms of Service

These Terms of Service ("Terms") govern your access to and use of Moonsys, including the Moonsys Discord bot and the Moonsys web dashboard at moonsys.xyz (together, the "Service"), operated by Adam Creative Studios ("Moonsys," "we," "us," or "our"). By adding the Moonsys bot to a Discord server, or by accessing the dashboard, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must meet Discord's own minimum age requirement (currently 13, or higher where required by local law) to use Discord and, by extension, the Service. If you add the Moonsys bot to a server or sign in to the dashboard on behalf of an organization, you confirm you have the authority to do so and that you agree to these Terms on that organization's behalf.

2. The Service

Moonsys is a Discord bot and companion dashboard that records a server's member count, joins, and leaves on a daily basis, and presents that history as growth graphs, trend-based projections, and related insights. Moonsys does not read, store, or process the content of your server's messages.

Moonsys is currently in early access and active development. Features, data presented, and pricing are not final and may change, be added, or be removed at any time, with or without notice. We do not guarantee uninterrupted availability, and the Service is provided on an "as available" basis during this period.

3. Adding and Removing the Bot

Only a user with adequate permissions on a Discord server may add the Moonsys bot to that server. Doing so authorizes Moonsys to receive and record the server data described in our Privacy Policy. Any server admin may remove the bot at any time through Discord; removal stops further data collection from that server, subject to the retention terms in the Privacy Policy.

We may suspend or terminate access to the Service for any account or server that we reasonably believe violates these Terms.

5. Pricing and Early Access

Moonsys is currently offered as early access and pricing has not been finalized. If and when paid plans are introduced, we will provide notice of the applicable pricing and terms before they take effect for existing users, and continued use of any paid feature after that notice constitutes acceptance of the updated pricing.

6. Intellectual Property

Moonsys, including its software, branding, design, and dashboard, is owned by Adam Creative Studios and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose, subject to these Terms. You retain no ownership interest in the Service itself; you retain ownership of your own Discord server data, subject to our processing of it as described in the Privacy Policy.

7. Disclaimers

Growth predictions and insights shown in the dashboard are statistical projections based on your server's own historical data. They are estimates, not guarantees, and their accuracy improves with more tracking history. We make no representation that any projection will be accurate or that any milestone will be reached by a projected date.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOONSYS AND ADAM CREATIVE STUDIOS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

9. Indemnification

You agree to indemnify and hold harmless Adam Creative Studios from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including a breach of these Terms. You may stop using the Service at any time by removing the bot from your server(s) and discontinuing use of the dashboard. Sections of these Terms that by their nature should survive termination (including Sections 6 through 9 and 12) will survive.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in California.

13. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without our consent; we may assign them freely. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Moonsys regarding the Service.
